These Terms of Use ( “Terms of Use”) govern the use of the All Island Dermatology, Plastic Surgery & Laser Center web site, www.allislandderm.com and www.allislanddermatology.com (collectively, the “Site”) offered by Joseph Onorato, M.D., F.A.A.D., P.C. d/b/a All Island Dermatology, Plastic Surgery & Laser Center (“All Island Dermatology”). Please read these Terms of Use before using or continuing to use the Site. Use of the Site constitutes an agreement to all terms and conditions in these Terms of Use. By using this Site you represent and warrant that you accept and agree to be bound by all of the terms and conditions contained herein and covenant to comply with these Terms of Use. Indemnification

Intellectual Property Rights

Failure by All Island Dermatology to enforce any provision(s) of these Terms of Use shall not be construed as a waiver of any provision or right.

The Site (excluding Third Party Sites) is controlled by All Island Dermatology which is headquartered in the State of New York, in the United States of America. It may be accessed from all 50 states, as well as from other countries around the world. Because each of these places has laws that may differ from those of New York, by accessing the Site, you agree that the laws of the State of New York, without regard to its conflict of laws rules, will apply to all matters arising from or relating to the use of the Site. Any controversy or claim shall be exclusively brought in the federal, state, or local courts of Nassau County, New York; and, with regard to such claims and disputes, you hereby irrevocably (i) submit to the exercise of personal jurisdiction over them by these courts, and (ii) waive any jurisdictional, venue or inconvenient forum objections to such courts. i. To provide you with information requested from us relating to our practice, including availability to schedule appointments.
ii. To notify you about any changes to our website, such as improvements or service/program changes, that may affect our service.
iii. To use in fundraising, promotional, informational or educational purposes of All Island Dermatology (de-identified).

We will only contact you or allow third parties to contact you when you have provided consent and only by those means for which you provided consent.

If you provide information with the intent or purpose of fraud or that results in either an actual crime of fraud for any reason including willful or un-willful acts of negligence whether intended or not, or in any way demonstrates or indicates attempted fraud, your non-medical information can be given to legal authorities including police, investigators, courts, and/or attorneys or other legal professionals, as well as any other information as permitted by law.

Information We Do Not Collect: We do not use cookies on our website to collect data from our site visitors. We do not collect information about site visitors except perhaps to count the number of visitors and no other data.

Limited Right to Use Non-Identifying Personal Information From Biographies, Letters, Notes, and Other Sources: Any pictures, stories, letters, biographies, or correspondence sent to us become the exclusive property of All Island Dermatology. We reserve the right to use non-identifying information about our patients for fundraising, promotional, informational or educational purposes.

Patients will not be compensated for use of non-identifying personal information. This information can be used without client’s express advance permission.

You may specifically request that NO information be used whatsoever for promotional purposes, but you must identify any requested restrictions in writing.

Security

Data that is provided to us is stored on our secure servers and we use commercially reasonable methods to keep information about you from unauthorized access. Nonetheless, the transmission of information via the internet is not completely secure and therefore we cannot guarantee the security of data sent to us electronically and transmission of such data is therefore entirely at your own risk. Where we have given you (or where you have chosen) a password so that you can access certain parts of our site, you are responsible for keeping this password confidential.
